The bank auditors and underwriters of Silicon Valley Bank have been targeted in a complaint filed in the San Francisco Federal court.

Legal troubles have emerged for industry leaders in the aftermath of the global banking crisis caused by the collapse of Silicon Valley Bank (SVB), which was friendly to cryptocurrency. KPMG LLP, the auditor of SVB, along with underwriters Goldman Sachs Group Inc, Morgan Stanley & Co., and Bank of America Corp, are reportedly facing a lawsuit for allegedly making misleading statements that resulted in the SVB crash.

Silicon Valley Bank Collapse Enters Court

A complaint has been filed in the San Francisco Federal court against the bank auditors and underwriters of Silicon Valley Bank (SVB). Among the defendants are SVB CEO Greg Becker and other bank executives. The complaint alleges that the defendants made misrepresentations about SVB's balance sheet strength, liquidity, and market position, while concealing the magnitude of the risks the bank was facing.

The complaint specifically targets KPMG LLP, SVB's auditor, and underwriters including Goldman Sachs Group Inc, Morgan Stanley & Co., and Bank of America Corp. The alleged misleading statements and omissions by the defendants are said to have resulted in the collapse of SVB, triggering a global banking crisis.

Bloomberg reported that the defendants in the lawsuit, including KPMG, Goldman Sachs, Bank of America, and Morgan Stanley, have not yet made any official statements regarding the matter. The lawsuit claims that the underwriters made misleading statements in the bank's stock offering registration comments, which ultimately led to its collapse. The lawsuit alleges that these statements were false.

According to WikiBIT, SVB Financial Group filed for Chapter 11 bankruptcy after failing to meet bond obligations due to a rise in interest rates. The report clarifies that the bankruptcy filings do not include SVB Securities, SVB Capital's funds, or general partner entities.

The lawsuit claims that KPMG is partially liable for the alleged misconduct because it approved Silicon Valley Bank's 2022 annual report just a week before the market close on March 8, 2022.
